1. Scope

Diese All­ge­mei­nen Geschäfts­be­din­gun­gen (nach­fol­gend «AGB») gel­ten für das Emp­feh­lungs­pro­gramm der Peak Per­so­nal GmbH (nach­fol­gend «Peak Per­so­nal»), bei dem Per­so­nen die Mög­lich­keit haben, poten­zi­elle Kon­takte für Fest­stel­len­ver­mitt­lun­gen an Peak Per­so­nal wei­ter­zu­lei­ten und dafür eine Pro­vi­sion gemäß den Bedin­gun­gen die­ser AGB zu erhalten.

2. Con­fir­ma­tion

By using our web­site and ser­vices, you expressly agree to be bound by these Gene­ral Terms and Con­di­ti­ons (GTC). Your use of our web­site and ser­vices con­sti­tu­tes your uncon­di­tio­nal accep­tance of these GTC. If you do not agree to these terms, please do not use our services.

3. Eli­gi­bi­lity for Participation

Eli­gi­ble for par­ti­ci­pa­tion in the refer­ral pro­gram are indi­vi­du­als who are of legal age and have the capa­city to enter into legal contracts.

4. Refer­rals

Indi­vi­du­als wis­hing to refer poten­tial cont­acts for job pla­ce­ments to Peak Per­so­nal must do so elec­tro­ni­cally by sub­mit­ting the cont­act details of the poten­tial cont­act to Peak Personal.

The refer­ral of a cont­act by an eli­gi­ble per­son does not gua­ran­tee suc­cessful pla­ce­ment by Peak Personal.

5. Com­mis­sion

Für jeden erfolg­rei­chen Kon­takt, der von Peak Per­so­nal an Dritte ver­mit­telt wird und der min­des­tens 100 Tage am neuen Arbeits­ort tätig ist, erhält die Per­son, die den Kon­takt wei­ter­ge­lei­tet hat, eine Pro­vi­sion in Höhe von CHF 1000 (nach­fol­gend «Pro­vi­sion»).

The Com­mis­sion will be paid to the eli­gi­ble per­son within 45 days after the expi­ra­tion of the 100-day work period of the refer­red cont­act, and only if the cli­ent has paid.

6. Pay­ment Conditions

The Com­mis­sion will only be paid if the refer­red cont­act com­ple­tes the full 100-day work period at the new place of employ­ment and the cli­ent has fully paid the pla­ce­ment fee to Peak Personal.

If the refer­red cont­act lea­ves before the expi­ra­tion of the 100-day work period at the new place of employ­ment, there is no entit­le­ment to the Commission.

7. Data Pro­tec­tion

By for­war­ding cont­act details of ano­ther per­son to Peak Per­so­nal, you agree that you are aut­ho­ri­zed to dis­c­lose these data and that you have obtai­ned the neces­sary cons­ents or appr­ovals from the affec­ted person.

As the cont­act pro­vi­der, you are respon­si­ble for ensu­ring com­pli­ance with data pro­tec­tion regu­la­ti­ons and for informing the affec­ted per­son about the dis­clo­sure of their data to Peak Personal.

Peak Per­so­nal under­ta­kes to treat the trans­mit­ted data in accordance with appli­ca­ble data pro­tec­tion laws and to use it exclu­si­vely for the pur­pose of job placements

8. Chan­ges and Termination

Peak Per­so­nal reser­ves the right to amend or ter­mi­nate these AGB as well as the refer­ral pro­gram at any time wit­hout lia­bi­lity to the eli­gi­ble per­sons. Chan­ges will be com­mu­ni­ca­ted to eli­gi­ble per­sons in wri­ting or electronically.
